Cardale Jones Trolls Ohio State Fans Into Thinking He Transferred To Akron

You hear that? That’s the sound of Buckeye Nation collectively catching their breathe after their National Championship winning quarterback dooped fans into believing he was taking his talents to Akron of all places.

Right off the bat, you have to think, “No fucking way.” Sure, Ohio State is littered with talent at the quarterback position with J.T. Barrett and Braxton Miller still on the roster, but no chance he’s suiting up as a Zip. Ohio State fans didn’t think that through, and immediately lost their minds.

King troll eventually came clean about the joke.

He ain’t here to entertain you or play school, he’s here to murder every team he faces on the gridiron. Forget losing, dude doesn’t know how to win by less than 100 points. If you’re Urban Meyer, you have no choice but to start him for that simple fact, right? Also, it’s good to see a college player stepping up to fill the void left by Manziel and Winston. #teamcontent

        That is not even remotely close to how liability works. First of all, The guy from vine is not acting in a professional or commercial capacity. Unlike Grandex, inc. here. Moreover, now that Grandex,inc has actual knowledge of the infringement you would be liable for any damages your unauthorized usage of the material caused. Moreover, you would also be liable for any unjust enrichment Grandex, inc. received from the infringement of said owners rights. (E.g. Increased volume, clicks, etc).

        Tech boy,

        There are several things wrong with your “tech crunch” on copy right infringement. 1) This ruling was in the 7th circuit. Which means it will only apply to the 7th circuit courts and not the 5th circuit (Grandex, Inc.) or 9th circuit (Fox Spotlight). So it is completely irrelevant. However, even if the 5th circuit applied the ruling the facts are not applicable.

        You’re argument seems to suggest that you would seek to apply Flava to the infringement by the user on vine to Grandex, Inc. however, the court would not make that analogy for two reasons 1) materially, “total frat move” is a different site than the “social bookmarking” character found in Flava. 2) In Flava, the access of the “infringed material” was merely for “personal use” whereas, here it is being used by Grandex, Inc. in a commercial capacity.

        17 U.S.C. § 512(c) Information Residing on Systems or Networks at Directions of users: A service provider (entity offering transmission, routing, or providing connections for digital online communications-[TFM]) shall not be liable . . . if the service provider: “does not have actual knowledge that the material or activity using the material on the system or network is infringing;” Or inversely, may be liable for violation of the above and a copyright owner will have a right to collect financial damages under §504 of the same act.

        Moreover, since Fox Searchlight (owner) is located in California this case may be relevant, Rosen v.Hosting Services, Inc. Wherein, it was held that a computer system operator can be held contributorily liable for infringement if it has knowledge of specific infringing material is available using its system and can take simple measures to prevent further damage to copyrighted works, yet continues to provide access to such work.

        For a case in the 9th circuit see, Fonovisa, Inc. v. Alvarez, which held that a claimant may bring an action for copyright infringement for ‘merely making [infringed material] works available’ to internet users. Under this language Grandex and TFM would almost certainly win however, it would have to go to court and that’s expensive….
