This would’ve been a Forum post, but thanks to Dorno I have to say this on an unrelated article.
I’m sick of people misinterpreting the 2nd amendment, Republicans and Democrats. It’s not about hunting or protection from home invaders, it’s about protection from your government and the ability to fight against the government if it becomes tyrannical. So when people say Americans shouldn’t be allowed to own assault rifles, I question whether they understand the Constitution. What if the fighters of the Revolutionary War hadn’t been allowed to own guns as good as the British?

It’s not used as a talking point (at least by smart people) because it is hopelessly outdated. You don’t seem to understand the point of the Constitution; it was purposely written to be vague and malleable because the Founders couldn’t predict the future needs of the country. Recreation or home protection is the only valid reason for guns, “fighting against the government” is for paranoid retards.
And Americans in the Revolutionary War weren’t on parity with the British. We had to raid British armories for guns and ammo or have them imported from France.

10 years ago at 2:39 pmThere are 1.38 million active personnel in our military. About 35 percent Americans report having a gun in their house and there are 89 guns per 100 people in America. That leaves about 290 million guns in America. For the sake of argument lets say that one tenth of those 290 million guns are put to use during a revolution against our sampled tyrannical government. Keeping in mind that this is a low end safe and reasonable estimate, we still out man our government’s military by 25:1 in this hypothetical situation. Soldiers on the ground have always and will always win wars. Not only that, in the given circumstance it would be politically unfeasible for our government to use drones, jets, bombs, etc. against it’s own “insurgents” (what the revolutionaries would be called by the media in such an event) because it would drastically swing public opinion against the government’s cause. So to sum things up, we wouldn’t need to be “on par” with our government’s infinite arsenal as long as our militia paralleled the small arms firepower of our military in said situation. Our victory would be triumphant, we would run train on our government’s asshole, and this is the very reason our government hasn’t disarmed the public to this day (Which there is absolutely nothing they would love to do more, in the name of “safety” to increase their own power as necessary).

I agree that it’s intent was to be somewhat vague because, as you said, they could not fortell the future. However, they left it open so that it could apply to everyone, not just those who wanted to kill deer and phesants.
I don’t follow you when you say it’s hopelessly outdated. It created the groundwork for our freedoms. Eventhough technology changes, the basic freedoms do not. Maybe I have misunderstood you. Can you expound?

10 years ago at 3:23 pmI am not going to criticize you but will instead try to teach you what the point of “shall not be infringed” means and why it is important to have an armed citizenry.
Bottom line upfront: It is a deterrent against excessive police power. Most liberty loving people mistakenly protest against cops. The real culprit is the large number of laws and regulations and the authority that cops are allowed to enforce that is the problem. A well armed community is a deterrent against crime.
The less crime there is, the less need for cops. The more crime there is, the more need for cops. When we need more cops, they get a larger budget and they hire more cops, which in turn must enforce more and more laws and regulation in order to justify the need for a large police force. The larger the police force becomes, the more it must be fed citations and charges to justify its existence.
It is a supply/demand issue.
Some of the worst organizations in our communities are the Police Unions. They clamor for more and more authority and they exaggerate crime and create a false sense of crisis in order to whip up support for more police and higher wages. They Unions do this because they receive dues from the policemen, which is usually around 5% of their salary. The Police Unions put out lots of information to the media touting about how dangerous police jobs are, when in fact policemen have one of the least dangerous jobs in the country. When a police force knows that the community is heavily armed, they treat its citizens with more respect.
One of the worst laws to ever be passed was the 1968 law that prohibited citizens with a felony from having most firearms. Any felony that gets you a sentence of one year or more, will take away your right. The law does not care if you are convicted of rape of tax evasion. Anything over a year does it. I bet you did not know that the second offense for not complying with ObamaCare is a tax evasion felony. If you refuse to comply with ObamaCare, you lose your gun.
Actually, Jefferson envisioned that we Constitution would evolve, but by amending it. Not by interpreting it. He surmised that we would have a new set of Amendments roughly every 20 years or so.
Arms mean arms, and yes, the point is to be able to overthrow the government, if necessary. And so what if assault rifles don’t put us on par with the government. First of all, this assumes all soldiers would side with the government over the people, doubtful. And second of all, the Brits outgunned us, we outgunned the Vietnamese etc. It’s not just about guns, it’s about motivation, numbers, knowing the terrain (home field advantage), and many other factors. There’s 300 million guns owned by 53 million Americans in this country that the government knows about. If the government tried to really pull some shit, yes, we could overthrow it, probably quite easily.
Lastly, saying that the right to bear arms covered in the Constitution is like saying that the Free Speech Clause of the First Amendment doesn’t protect what we are doing right now. Expressing our opinions on the internet. Because you know, the internet wasn’t around in 1789, just like AR-15’s weren’t.

While everybody knew the Confederation was not working, James Madison and the Federalists were seen as paving a way for the erosion of individual liberties, state and local governments, and eventually leading towards a monarchy. To get Samuel Adams, Patrick Henry, and other anti-Federalists on board for signing the document, the Bill of Rights was offered (albeit wasn’t officialy added until 2 years later) as a compromise to guarantee INDIVIDUAL rights. I find it rediculous that so many people see the 1st, then 3rd-9th as protecting individual rights while the 2nd Amendment is collective. That idea is even rediculous when one remembers that the establishment of an army was already addressed in Article 1.

One purpose certainly was to protect the right of the people of each colony to keep their state militias well-regulated, meaning among other things, well-organized and well-armed. It was as much about state vs. federal power as it was about an individual’s rifle, or a town’s rifles. Scholars have made both arguments for over 200 years. Neither view is entirely right or wrong. And more tits, dammit.

Do you really think your pistol or hunting rifle is going to help if the government decides to (for some reason) become tyrannical?? And so that begs the question, “Where do we draw the line?” To actually fight the United States fucking government you would need tanks, anti aircraft equipment, all kinds of shit. And I think we agree that the average citizen should not be able to walk into a store and buy a rocket launcher. The constitution is outdated, man. I don’t mind people owning weapons for protection and hunting. But I also believe there is no reason to own an assault rifle.
