Republicans Propose Bill To Protect Fraternities, Ensure Due Process Rights

A bill was introduced to congress Wednesday by Republicans that would ban universities from forcing fraternities to go co-ed, and would strengthen the due process rights for both students and Greek organizations alike. The legislation proposed would prevent campus investigations into sexual assault until the victim reports allegations to law enforcement, as well.

With the support of lobbyist groups like FratPAC, Republicans are pushing the bill to combat campuses from hastily complying with Title IX, rushing the process, and suspending and dismissing students with little evidence. This would also apply to student organizations, not just individuals.

From Inside Higher Ed:

The legislation would require a college to conduct a full discipline hearing before a chapter could be banned from campus. Interim sanctions, such as suspension, during this process could only last 10 days.

The legislation would also prohibit colleges from ordering fraternities and sororities to become coeducational. In September, following a series of alleged sexual assaults, Wesleyan University told its fraternities that they must admit women in the next three years. One of the chapters is suing the university, alleging the order is discriminatory.

The right to due process is one of the fundamental principles this country was built on. Listen, I get that some victims of sexual assault may not feel comfortable going to the police, but only involving student conduct code hearings just isn’t going to cut it with something of this serious nature.

I’m interested to see how this all plays out in the coming weeks.

    Having not read it in its entirety, I would still venture to say this may not be the best written or most thorough law to deal with the way universities have been stepping on student rights, but it damn sure is nice to see that people are listening. Always gives me hope to see reason prevailing.

        It’s an initial reaction to what I’ve gathered about the bill, thus the disclaimer that I haven’t read it thoroughly. Have you ever read a bill in its entirety? That shit is usually long as hell. Haven’t had time for that yet.

    Here’s something that I thought about for a bit, and I want to know if it would hold up in a court of law:

    Let’s say that I am on a campus with a “No Means No” policy, and after a pretty decent night, I take a girl up to my room (for convenience’s sake, I’ll call her Nikki). Nikki and I are both somewhat tipsy and visibly so, but we’re both still coherent and we’re both alert. We’re both consenting nonverbally by reciprocating willfully during the time we’re upstairs, and the policy makes it very clear that we’re both in the clear.

    However, repeating the scenario in an identical way with a “Yes Means Yes” policy gets strange really quickly. Although Nikki and I were both willing participants while having sex, legally, I have committed sexual assault because I cannot prove that she verbally consented; even though her actions, namely, helping me strip her down and her initiating contact by pulling me onto her indicate that she was physically consenting.

    I contend that a “Yes Means Yes” policy creates significant issues because while either partner may withdraw consent at any time (and that I have no issue with), there is no clearly defined line that indicates that either partner has withdrawn consent. In short, it is utterly unenforceable.

      The scariest thought is the girl is always believed and even if you can some how manage to prove your innocence.You are still fucked as your name and reputation has been dragged through the mud. There is just so much hate coming from feminist that they literally want to destroy men in every way possible. They preach the narrative that the school does nothing regarding rape reports. Yet we are seeing countless stories of male students getting expelled on an accusation alone. So many colleges are becoming increasingly hostile toward males…especially privleged white males. Lastly they act like false rape accusations almost never happen. However, according to the FBI over 60 percent of rape kits come back negative. Even more terrifying the rape kit will come back false and the accused is still convicted with scientific evidence telling something else. Glad to see some common sense being applied to these issues for once… Feminists can cry rape apologists all they want but innocent until proven guilty and due process will win
