Four Albany Students Arrested After Pledge’s Hazing Death
In November of last year, a 19-year-old pledge named Trevor Duffy was forced to drink a handle of Belvedere vodka during a pledging ceremony. He passed out, and after an argument, the fraternity brothers finally called for help. When paramedics arrived, they found him with a BAC of .583. He later died at a nearby hospital. While the students claimed to represent Zeta Beta Tau, neither the university, nor the national fraternity recognize their organization, therefore making them unaffiliated.
Authorities in Albany seem to be wrapping up their investigation into the case and have formally charged and arrested four students for their roles in Duffy’s death.
From People:
Olaf Jablonski, 20, Yuval Sucov, 20, Jonathan Maldanado, 21, and Steven Vila, 22, are all charged with first-degree hazing, a misdemeanor, in Trevor Duffy’s death, spokesman Steven Smith says.
According to an earlier article on the incident, Duffy’s parents believe that he was forced to drink and suffered before his death.
From News10:
The claim was filed by Duffy’s father, Stephen Duffy. He did not want to comment on the potential lawsuit, but the claim states he believed his son suffered for hours and was pushed to drink heavily by a recognized Jewish fraternity, Zeta Beta Tau, at the school.
…
The claim further states Duffy suffered severe conscious pain leading to his death. It also alleges the university was negligent and failed to warn and protect students against hazing and the fraternity.
Since their son’s death, Duffy’s parents have filed a $55 million lawsuit against the school.
Police said that while four have already been arrested and charged, there are more charges pending, and several more could be arrested in the coming days..

Having someone drink an entire handle is just plain fucking stupid. This is what gives Greek life a bad rep.
11 years ago at 10:27 amI actually did that once
11 years ago at 12:21 pmFuck off
11 years ago at 12:27 pmAs tragic as the death is he alone drank himself to that point. Was there pressure? Definitely. But did they tie him down and waterboard him with Vodka? No. How can the school be accountable for those actions? Such a sad story but people really should have to take responsibility for themselves. Suing the school is outright ridiculous.
11 years ago at 10:30 amIt’s negligent homicide.
11 years ago at 10:34 amNot really.. The college wasn’t negligent, his ZBT brothers were. ZBT is unrecognized, while I hold some esteem for unrecognized frats, that’s basically the equivalent of joining the bloods and then suing them when you get shot..
11 years ago at 10:36 amThe school is probably being sued on the grounds that they allowed this type of hazing to occur. It doesn’t matter that policing it is difficult they’re still liable because ZBT was a campus organization.
11 years ago at 10:44 amThe college meets at least some elements of negligence. If there’s a state law that requires colleges to educate on hazing, and they didn’t, UAlbany is fucked regardless of ZBT’s affiliation with the school. Maybe not 55mil fucked, but still.
11 years ago at 10:51 amAlso, I don’t think you understand negligence as a legal concept. I don’t know why I’m heated about this, maybe because I’m tired of reading these stories in the first place. It’s all too commonplace, and it’s goddamn tragic. But I can’t abide ignorant folk like you blaming the dead, simply because you can’t or won’t recognize problems that Greek Life needs to address as a whole.
11 years ago at 11:09 amBut they are unrecognized, which basically makes them a gang. If a gang shoots you on school grounds, I’m pretty you can’t sue your college. If the school cut all ties with the organization, how can they be to blame?.. That’s comparable to a school having to fix a water main break, there being a large hole in the ground, and having signs saying AVOID AT ALL COSTS, and you still choose to jump into the hole, and then your family suing after your death. The family had no control over the incident of course, but their son CHOSE to pledge unrecognized. Anyone knows that comes with a higher risk
11 years ago at 11:21 amTo reiterate: I don’t think you understand negligence as a legal concept.
11 years ago at 11:33 amFucked, doubtful. I’m 100% sure that the family chooses a jury trial, rather than a decision reached by the Judge. I’m also sure that liability is much less than 50% of what they are asking for. They probably settle at the first or second trial appearance after a prolonged discovery. I would be shocked if the school settled for anything higher than a few million, if even that high.
The ZBT “brothers” will probably pony up a ton of cash though.
11 years ago at 11:17 amAfraid you’ve got the wrong take on this, sport. Legally speaking, there’s enough here for a prima facie negligence case against the school. But just in general, are you kidding me? Assuming a 19 year old pledge has the presence of mind to bail on that situation, especially with at least a 5th in him? What if it was the last night of hell week? Mental coercion can be just as binding as physical. This is on ZBT, and you should have some respect for the deceased.
11 years ago at 10:45 amIotaKappa here has it right, but that’s still up to the court. More importantly, this isn’t a case where you can defend fraternity – as individuals or as a whole. Regardless, they pressured a kid to the point of death and put that same risk on every other pledge, and sounds like they’ve done the same each semester prior. They’ve been playing Russian roulette on their pledges.
11 years ago at 11:03 amYeah, I’m not saying it’s a surefire win for the family, but it’d survive a motion for summary judgment. In all likelihood, UAlbany is hitting the settlement button before it even reaches a courtroom.
11 years ago at 11:16 amNo doubt it never reaches the trial phase, but if the ZBT brothers aren’t named in this action, the school will absolutely name them in a second action in which they are third party defendants, and shift the majority of the negligence onto the brother’s themselves. What’s a few million to a school though.
11 years ago at 11:20 amLet’s talk jurisdiction and proper venue!
11 years ago at 11:29 amThe comment section on TFM is definitely the proper venue
11 years ago at 12:20 pmA forum would be a proper venue @TFM
11 years ago at 12:27 pmZing
11 years ago at 2:24 pmLet’s talk proximate cause. Plaintiffs likely cannot prove it. Plus, what is the college’s duty in terms of protecting a student from actions by 3rd parties? What chance did the college have to prevent the death? Sounds like fishing for a nuisance settlement.
11 years ago at 6:06 pmThis is absolutely not on ZBT. as an Albany Greek life alum. I can attest to the fact that the group this kid joined was a previous iteration of ZBT that was kicked off campus about 15 years ago yet still operated underground until this happened, all the while claiming fraudulently to be “ZBT”. the current recognized chapter by the school was recolonized in the past 8 years or so and has absolutely no affiliation with the lowlifes that killed that young man, in actuality the underground group antagonized the recognized group constantly and attempted to start brawls and other issues as often as they could. This article should be revised as it’s unfair to the actual recognized chapter at the University at Albany; they had nothing to do with this incident and shouldn’t be grouped in with the scum that killed that kid. ZBT nationals shouldn’t be culpable for this in the slightest, they disaffiliated with this group nearly 2 decades ago.
11 years ago at 11:53 amApologies; when I said it was on ZBT, I was referring to this unrecognized group. I pledged an unrecognized house myself (although we’re federally incorporated, properly domiciled, etc.) and it’s worth mentioning that for every “gang with letters,” there are two or three established, well-run houses that just got tired of dealing with administrative bullshit, either from former nationals or a school.
11 years ago at 2:35 pmHey IK, are you from Potsdam?
11 years ago at 12:51 pmGod I miss that place
11 years ago at 8:04 pmIt’s such an unfortunate situation.. As someone who goes to school about an hour from UAlbany, this really hits home, but what really sucks is that his family has no chance of winning.. Those are the risks of pledging unrecognized. It can be really hard to point fingers when something like this happens and expect some sort of closure. Have to agree with everyone else though, doesn’t seem like he was tied down and forced to funnel a handle of vodka, so that makes it even harder to direct the blame.. Either way, rest in peace. Prayers go out to his family.
11 years ago at 10:34 amI think you may be jumping the gun a little bit there buddy. My fraternity has been banned for the past six years and situations such as this one never have, and never will occur. We still carry one of the highest average house GPA and participate in multiple fundraiser events each semester. I am from the Albany area and I have been aware of this house along with a few others for multiple years. Morons. However, their actions have nothing to do with being an unrecognized fraternity. It has to do with their childish and irresponsible behavior. They are going to have to pay the price now.
11 years ago at 12:48 pmI pledged at UAlbany at a recognized fraternity and transferred out as a junior. ZBT was unrecognized and a bunch of flat brim wearing “thugs”. Big brother night in Albany is extremely dangerous. Basically 3-6 hours of education then straight to getting forced to polish off a bottle of your big’s choosing (normally a handle), then more drinking at an after party. Greek life at this school sucks. ZBT sucks more.
11 years ago at 10:43 amP.S. ZBT doesn’t pull
One more thing: The school sends out emails to underclassmen at the beginning of every semester telling students which unrecognized orgs to watch out for. Being affilited with or pledging an unrecognized org can get you suspended. This isn’t a jewish fraternity, it’s a gang. In fact, there’s a recognized ZBT on campus. Might need to revise the article a smidge. These guys are in the same boat as the Albany SAMs yall wrote an article about a couple years ago.
11 years ago at 10:52 amZBT = NF
No pull murderers. NF.
11 years ago at 10:52 amYou literally can not drink a handle in that short of a period. I’m sure many of us have finished a handle over the course of a long day of heavy drinking, but you will die if you chug it. I find that hard to believe.
11 years ago at 10:52 amThis is so fucking stupid. There are 59.2 ounces in a handle, which, assuming there are 1.5 oz in a shot, equates to nearly 40 drinks. Unless you’re 300 lbs or a legit alcoholic I’m calling absolute bull shit.
11 years ago at 11:11 amLegit alcoholism. TFM.
11 years ago at 1:42 pmI went to high school with Jonathan Maldonado. He is so stupid I honestly can’t even understand how he got accepted into college.
11 years ago at 10:59 ami know a john maldonaldo from the poughkeepsie area don’t know if its the same kid
10 years ago at 1:23 amDo you know how fucking easy it is to not kill someone? Seriously you do it every day. Like I get that this is a sad story but god damn now a university is getting sued for $55 million dollars, and you wonder why universities try and shut down Greek life as whole. All because a chapter couldn’t not kill someone.
11 years ago at 11:07 amI know pledges suck, their lives are worthless and they suck an infinite amount of dick. But you should be responsible enough to know when to stop or slow down or at least give one particular pledge a break (i.e. when my pledge bro got knocked unconscious on accident, they gave him a day off)
11 years ago at 11:46 amNow is really not the time to say pledges lives are worthless, you fucking asshole. Have some respect. Prayers for the Duffy family.
11 years ago at 11:53 amMy view towards pledges came off as way too aggressive. I was meaning to say that pledges suck but they’re still human beings and actives need to know when to slow down when starts heading towards medical troubles. I’m sorry guys, that was very distasteful of me.
