Actually its not illegal, there is no law anywhere against defacing a picture. Even if he did say “Obama”, the right to shoot an image of his face is protected by the First Amendment. Its in dicta in the Supreme Court decision in Texas v. Johnson (flag burning was a protected form of free speech). Law Review. TFM.
yeah… um 18 U.S.C. 871 says you can’t threaten the president (vice president, or next in line in the order of succession, etc…) in “mail or for a delivery from any post office or by any letter carrier any letter, paper, writing, print, missive, or document.” Sadly shooting a picture isn’t on that list.
AND even if you do these things… the penalty is a fine or jail time not to exceed 5 years. See I actually read the statutes I’m referencing statutes… and that’s why I’m on law review.

I’ll leave it up to law review how to explain to the guys waterboarding him that it wasn’t a true threat.
